Designs Protections in Australia

Your designs can be protected in Australia under the regime of the Design Act 2003. The initial period of registration for your design lasts for five years from the date of filing. The Act provides better enforcement and dispute resolution procedures.  Our IP lawyer can provide services in relation to obtaining the design protections, enforcement and infringement actions. 

 


Application for a design protection

Registration initially protects your design for five years from the  date of the application was filed.  The design registration can be renewed for a further five years. 

The Designs representation can be drawings, photographs, or digital images.  The representation should show an accurate and complete picture of designs and can be printed or mounted on an A4 quality white paper sheet.

Design patents certificate can be obtained before a thorough examination is requested.  However the protection of the design shall be limited without a detailed examination certificate to be issued by the Registrar.

Design Database
The Registrar IP Australia has kept a database of designs for the public to search through their web site ipaustralia.gov.au.
